Your rights and our obligations under India's Digital Personal Data Protection Act, 2023 (DPDP Act).

Applicable Law

This Data Privacy Policy applies to users in India and is governed by the Digital Personal Data Protection Act, 2023 (DPDP Act). Indian Kitchen acts as a "Data Fiduciary" as defined under the Act, meaning we determine the purpose and means of processing your personal data.

We are committed to processing your personal data lawfully, fairly, and transparently in full compliance with all applicable Indian data protection regulations.

Right to Information

You have the right to obtain a summary of the personal data we hold about you and know the identities of all third parties your data has been shared with.

RIGHT 2

Right to Correction & Erasure

You may request correction of inaccurate personal data and request erasure of data that is no longer necessary for the purpose it was collected.

RIGHT 3

Right to Grievance Redressal

You have the right to a readily available means of grievance redressal. We will acknowledge your complaint within 48 hours and resolve it within 30 days.

RIGHT 4

Right to Nominate

You may nominate another individual to exercise your data rights on your behalf in the event of your death or incapacity.

RIGHT 5

Right to Withdraw Consent

Where processing is based on consent, you may withdraw it at any time. Withdrawal will not affect the lawfulness of processing prior to withdrawal.

Data Retention

We retain personal data only for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable law. Once data is no longer required:

  • It is securely deleted or anonymized within 90 days of the retention period ending
  • Transaction data is retained for 7 years as required under Indian tax regulations
  • Marketing data is retained only while you remain an active subscriber
  • Account data is deleted within 30 days of account closure upon your request

Cross-Border Data Transfers

Where personal data is transferred outside India, Indian Kitchen ensures that such transfers are in compliance with the DPDP Act and applicable rules notified by the Central Government. We only transfer data to countries or entities that provide adequate data protection safeguards.

Note: Currently, Indian Kitchen processes and stores data primarily on servers located within India. Any cross-border transfer will be disclosed to you at the time of collection.

Children's Data

Indian Kitchen does not knowingly collect personal data from children under the age of 18. In accordance with the DPDP Act, we require verifiable parental consent before processing any personal data of a child. If we discover that personal data of a minor has been collected without consent, we will delete it promptly.
